We, the undergraduate student body of New Mexico Institute of Mining and Technology, in order to provide for effective, efficient, and representative means of self-government, establish this Constitution of the Student Association of New Mexico Institute of Mining and Technology. We, the Student Association Government of New Mexico Institute of Mining and Technology, will identify student concerns, address significant student issues, and work together with the Institute and surrounding community to enhance the NMIMT experience of today and tomorrow. :-)
Foreword and Definitions
Foreword SANMIMT Government offices, SANMIMT Government positions, and SANMIMT Government agents named herein may be referred to without full prefix (i.e. SANMIMT Government President referred to as President or SA President). Any student in any SANMIMT Government position named herein must be in good standing. For all issues not covered in this Constitution or the Book of Law, the SANMIMT recognizes and uses the most recent version of Robert's Rules of Order. In all cases, the Constitution and Book of Law supersede Robert's Rules or Order.
Definitions Academic session: the three times in the year in which classes are meeting or testing. These times are referred to as the Fall Semester, Spring Semester, and Summer Session. Agency: any group authorized by this Constitution, or by law, to represent the SANMIMT, and/or to expend SANMIMT Government funds. Agent: any individual authorized by this Constitution, or by law, to represent the SANMIMT, and/or to expend SANMIMT Government funds; including all elected and appointed students within the SANMIMT Government and all members of its committees. Anticipated revenue: the amount of funds anticipated from the SANMIMT Fee as reported by the SANMIMT Chief Financial Officer. Chair: the person designated to preside over any meeting. Day: any regularly scheduled University school day, unless specifically stated otherwise. This excludes Saturdays and Sundays. Executive agency: any group that directs or oversees any interest of the Executive Branch as stated in Article IV, Section 5 or by law. Executive agent: any individual that directs or oversees any sub-organization of the Executive Branch as stated in ARTICLE IV, Section 5 or by law. General Election: the election held each session with the primary purpose of electing Senators. Good standing: not on any type of University probation and at least a 2.0 cumulative grade point average. The only exception to the required 2.0 cumulative G.P.A. is if the student is newly entering the University and has no G.P.A. Graduate Student Association of New Mexico Institute of Mining and Technology (GSANMIMT): the graduate student body of the University and its representative government. Gross misconduct: A forbidden or unlawful act performed intentionally with indifference to known or obvious harmful consequences. Major: an academic field of study ending in a degree offered by an academic department as part of either the Arts & Sciences curricula or Engineering curricula as defined by the most recently published New Mexico Tech Catalog. (A student shall be defined as a member of one (1) of these two (2) divisions according to their first major.) Malfeasance: commission of a wrongful act which an official has no legal right to do, or any wrongful conduct which affects, interrupts, or interferes with the performance of official duty or an act for which there is no authority or warrant of law. Neglect of office: intentional failure to attend to one's official duties. Officer: any student holding a position in an SANMIMT Government funded organization and all elected or appointed students serving in the SANMIMT Government. Organization: any group which meets the chartering requirements of the University or the SANMIMT. Quorum: a quorum of the Senate shall consist of fifty-one percent (51%) of the seated Senate. SANMIMT Government: the representative body of the SANMIMT, established to pursue student concerns, regulate student affairs, and be the official voice of the SANMIMT. Semester: either of the academic sessions, Fall Semester or Spring Semester, from the first day of classes up to and including the last day of finals. Special election: An election other than a General Election held by the Supreme Court. Student: any person enrolled in the University; in an undergraduate status. Student Association of New Mexico Institute of Mining and Technology (SANMIMT): the undergraduate student body of the University. Term of office for the President and Vice President: term is one (1) year, beginning the first calendar day after Commencement of the Spring Semester and ending the calendar day of Commencement the following Spring Semester. The President and Vice President may serve a maximum of two (2) terms within the office to which they were elected. University: the educational division of New Mexico Institute of Mining and Technology and all associated sectors.
Student Rights
Assertion These are the rights recognized by the SANMIMT and governing the operation of the SANMIMT Government. The SANMIMT Government shall promote these rights within the University community. The SANMIMT asserts the right of student representation on University committees dealing with the formulation of policies affecting students. Any action that violates University policies, including those in the Student Handbook, shall be prohibited.
Rights Every student has full and equal rights in the University regardless of sex, race, color, national or ethnic origin, religion, physical or learning disability, creed, handicap, sexual orientation, marital or parental status, age, or military involvement. Every student has the right to vote in accordance with normal procedures established by the SANMIMT Government. Every student has the right of access to all SANMIMT Governmental records. No student shall be denied the right of orderly assembly on the campus. Every student has the right to contest before the Supreme Court the constitutionality of legislation, rulings, or decisions of the SANMIMT Government or any chartered organization that would affect students. All students shall be considered innocent of any infraction of SANMIMT Government laws until proven guilty in a hearing of the appropriate judicial body and shall not suffer direct or indirect penalties for an infraction until guilt has been established. No student shall be compelled to be a witness against him or herself and shall be properly informed of the nature and the cause of the accusation. The student shall have a fair and impartial hearing by the appropriate judicial body in which he or she will be confronted by the witnesses against him or her, and may utilize the assistance of counsel in any part of the proceedings.
Legislative Branch
Senate All legislative powers of the SANMIMT Government shall be vested in the Senate.
Legislative Function The Senate shall make all laws and regulations it deems necessary and proper for the SANMIMT Government, appropriate all funds of the SANMIMT, approve or disapprove all appointments to constitutional and statutory executive agencies and legislative committees made by the President and Vice President, and impeach specified officials for due cause.
Composition of the Senate The Senate shall consist of five (5) undergraduate students whose first major is in the Arts & Sciences and five (5) undergraduate students whose first major is in Engineering, elected during the Spring General Election. Eight (8) undergraduate students shall be elected from the student body as a whole during the Fall General Election. Three (3) graduate student Representatives shall reside on the Senate as voting members and shall be chosen by the GSANMIMT. The term of office for each Senator shall be the two (2) sessions of the Senate following the election of the Senator, excluding Senators elected during a special election. The Senate body shall not exceed twenty-one (21) members including all Senators and GSA Representatives.
Qualifications of Senators No Senator, during the time for which he or she holds office, may serve in any other branch of the SANMIMT Government or as an officer of a SANMIMT Government funded organization, unless he or she is confirmed by two thirds (2/3) of the seated Senate.
Powers of Subpoena The Senate shall be empowered to subpoena SANMIMT members to appear before it or any of its committees by a majority vote of the seated Senate. Any student or group failing to comply with a properly issued subpoena may be suspended from SANMIMT Government offices and committees.
Legislation Legislation must be submitted to the Vice President in the form of a bill no later than three (3) days prior to the Senate meeting in which it is to be acted upon. The Vice President shall provide all legislation to all Senators for their review no less than two (2) days prior to the appropriate Senate meeting. At the discretion of the Vice President, or at request of two (2) Senators, any person may be allowed to testify about any legislation during the Senate meeting in which the legislation is to be voted upon. A bill passed by a majority vote of the Senate shall become law upon the signature of the President within five (5) days after its passage. A bill left unsigned by the President on the sixth (6th) day after its passage shall be considered vetoed. All vetoed legislation must be presented to the Senate by the President at the next Senate meeting after being vetoed, accompanied by a written explanation of why the bill was vetoed.
Senate Administrative Officers The Vice President shall be the president of and preside over the Senate, and shall have no vote except in the event of a tie. The Vice President shall preside over Senate meetings in accordance with Robert's Rules of Order. The Vice President shall have earned a minimum of thirty (30) credit hours at New Mexico Institute of Mining and Technology. Preceding the Spring General Election, the Vice President shall prepare and submit to the Senate Finance Committee a budgetary proposal for the Legislative Branch for the next fiscal year. The budgetary proposal shall include the Senate, Senate committees, Senate employees, and SA Government offices under the jurisdiction of the Vice President. The Vice President shall hire a Secretary for the purpose of taking the minutes of Senate meetings, managing all SANMIMT Government records, and assisting the President in any clerical activities deemed necessary. The Secretary is at the service of the three (3) branch heads of the SANMIMT Government (President, Vice President, and Chief Justice) and shall be the direct employee of the Senate. A President Pro-Tempore of the Senate shall be elected from the membership of the Senate by plurality. The President Pro-Tempore of the Senate shall preside over the Senate in the absence of the Vice President. In the event that the office of the Vice President is vacant, the President Pro-Tempore of the Senate shall assume the title and duties of the office. The President Pro-Tempore of the Senate shall be reelected each session of the Senate or when the position becomes vacant. The President Pro-Tempore of the Senate may be removed by a majority vote of the seated Senate at the first meeting following the introduction of a motion for removal.
Senate Committees The Senate shall have the power to designate Senate committees as necessary. The Vice President shall appoint all chairs and members of Senate committees with the concurrence of the Senate. After three (3) consecutive rejections of a Vice Presidential appointment to a position, the floor shall be opened to nominations by the Senate. Appointments to Senate committees will expire the day of the first meeting of the session immediately following the session in which the appointments were made. Only students may serve on committees. Any student may serve on a SANMIMT committee with the exception of the limitations on the Finance, Legislative Standards, and Appointments Committees. All Senate committees, with the exception of the Finance Committee, may reelect their own chair. The Finance Committee shall be established to investigate budget requests and make recommendations on the budget of the SANMIMT Government to the Senate. Legislation concerned with finances shall be referred to this committee. The Finance Committee shall submit a complete budget for each academic session, including chartered organizations' budgets, to the Senate by the second Senate meeting of each academic session. This complete budget shall include changes to Government branch and executive agency budgets. This committee shall be composed of seven (7) students, of which a minimum of five (5) must be Senators, and the Chief Financial Officer. The Chief Financial Officer shall serve as chair and shall have no vote. Meetings shall be held at least once every two (2) weeks during the regular academic year and at least two (2) times between the end of the Spring Semester and the beginning of the Fall Semester. The Legislative Standards Committee shall be established to review all legislation not allocating SANMIMT Government funds. This committee shall be composed of five (5) to seven (7) Senators. One (1) of the Senators shall serve as chair and shall have no vote, except in the event of a tie. The Appointments Committee shall be established to consider all Presidential appointments and make recommendations to the Senate. This committee shall be composed of three (3) to five (5) Senators. One (1) of the Senators shall serve as chair and shall have no vote, except in the event of a tie.
Sessions of the Senate There shall be two (2) sessions of the Senate each academic year. The first session shall begin the calendar day before the first day of classes of the Fall Semester. The second session shall begin the calendar day before the first day of classes of the Spring Semester. The President, Vice President, and all Senators shall take an oath of office administered by a Supreme Court Justice at the first Senate meeting of the session. The Senate shall meet on the call of the President, the Vice President, or upon petition of at least one third (1/3) of the Senators. Meetings shall be held at least every two (2) weeks while classes are in session.
Salaries The Senate may, with the exception of the President and Vice President, establish salaries for the purpose of compensation for student officials and employees. Compensation may not be diminished during an individual's term of office. The salaries ot the President and Vice President shall be set at two (2) times the in-state tuition (as published in the New Mexico Tech Catalog) of the academic sessions covering their terms in office. The President and Vice President salaries shall be drawn from SANMIMT funds. Senators shall not receive a salary or wage for executing his or her duties as a Senator. No more than one (1) salaried position in the SANMIMT Government may be held by any one (1) student. All hourly salaries being paid by the SANMIMT Government shall meet at least federal minimum wage.
Senate Disciplinary Action The Senate may determine the rules of its procedure, discipline its members for neglect of office and/or disorderly behavior in its presence; and may, with concurrence of two thirds (2/3) of the seated Senate, expel a member. In the event an expelled Senator is reelected, he or she cannot be expelled a second time for a previous action.
Chartering Authority The Senate may, with approval of a proper constitution by the Supreme Court, choose to charter an organization that it determines as meeting a necessity among the University community. Any chartered organization must have a membership that is at least seventy-five percent (75%) SANMIMT members and/or GSANMIMT members. Any chartered organization must have a minimum of five (5) members of the SANMIMT and/or GSANMIMT to receive funding from the SANMIMT.
Executive Branch
The President The President is the spokesperson and representative of the Student Association and its Government. The President is responsible for the administrating of student activities and SANMIMT funds, for representing the SANMIMT in dealings with entities outside the SANMIMT, and for upholding the Constitution of the SANMIMT. The President shall have earned a minimum of thirty (30) credit hours at New Mexico Institute of Mining and Technology. In the event that the office of the President is vacant, the Vice President shall assume the title and duties of that office.
Powers and Responsibilities of the President The President may make executive rulings necessary for the enforcement and execution of this Constitution and SANMIMT Government legislation which are not in violation of this Constitution and SANMIMT Government legislation. At least twice during each session, the President shall give the Senate information in person, as to the state of the SANMIMT Government and may recommend such measures, as he or she deems necessary. Preceding the Spring General Election, the President, in consultation with his or her executive officers, shall prepare and submit to the Senate Finance Committee a budgetary proposal for the next fiscal year for the Executive Branch of Government. The budgetary proposal shall include operating costs for the SANMIMT Government offices with the exception of those that fall under the jurisdiction of the Vice President. The budgetary proposal shall exclude executive agencies unless an executive agency does not have a director. If the President prepares a budget proposal for an executive agency while an agency has no director and a director is appointed before the Spring General Election, the director may take control over the executive agencies budget proposal if the director so wishes. The President may establish and appoint any executive officer or executive agency to advise and assist him or her in the execution of his or her prescribed duties. The tenure of these appointments shall not exceed the term of office of the appointing President.
The Executive Office of the President There shall be an executive office of the President composed of a Chief Financial Officer, a Governmental Affairs Officer, a Student Activities Director, and any other executive officers the President might appoint. It shall be the duty of this office to advise and assist the President in the execution of his or her duties. There shall be a Chief Financial Officer appointed by the President and confirmed by the Senate, who shall oversee the finances of the Executive Office and handle all finances as directed by the Senate. There shall be a Governmental Affairs Officer appointed by the President and confirmed by the Senate, who shall be the designated representative of the SANMIMT to the Associated Students of New Mexico (ASNM), the Commission on Higher Education (CHE), and Legislative meetings in which the SANMIMT has an interest. There shall be a Student Activities Director appointed by the President and confirmed by the Senate, who shall coordinate and oversee any and all committee activities that are for the entertainment or improvement of the student body. These include, but are not limited to 49ers, Spring Fling, dances, and movies. The Student Activities Director may appoint any assistants that they deem necessary with the approval of the President.
The Executive Cabinet There shall be an Executive Cabinet composed of the President, the Chief Financial Officer, the Governmental Affairs Officer, the Student Activities Director, the directors of all executive agencies, and any other officials or persons prescribed by the President. The Executive Cabinet shall advise and assist the President in his or her duties as well as facilitate cooperation and coordination among the executive agencies and executive officials.
Executive Agencies The President shall appoint all directors of all executive agencies, to be ratified by the Senate. All other student appointments to executive agencies shall be made by the executive agency's director, with the consent of the President. The term of office for agency membership shall coincide with that of the President. The President shall be empowered to remove any of his or her appointments to any executive agencies. B. Preceding the Spring General Election, each executive agency's director shall prepare and submit to the Senate Finance Committee a budgetary proposal for the next fiscal year for the director's executive agency.
Judicial Branch
Judicial Function The Judicial power (including Constitutional and legal interpretations) of the SANMIMT Government (with the exception of impeachment) shall be vested in the Supreme Court.
Jurisdiction The Supreme Court shall have original jurisdiction in all cases arising under this Constitution, the laws and bylaws of the SANMIMT Government, the regulations and actions of the various bodies and committees of the SANMIMT Government with the exception of certain designated powers of the Senate. All legislation signed or passed into law, motions passed by the Senate, and referenda and amendments passed by the student body must be submitted to the Supreme Court to be checked for constitutionality.
Justices The Supreme Court shall be composed of a Chief Justice and four (4) Associate Justices. The justices must have attended the University at least one (1) semester immediately prior to their appointment. The Chief Justice and Associate Justices shall be appointed by the President and confirmed by the Senate. The term of office of the Chief Justice shall be one (1) year. Associate Justices shall serve two-year terms. The Chief Justice shall preside over the Court and shall be responsible for the publication of the decisions of the Court. Two (2) justices from the Supreme Court shall be members of the University Disciplinary Committee. Not less than one (1) Justice shall be present at each meeting of the Senate.
Procedures A decision of the Court shall be made with the written concurrence of at least three (3) of the justices. Appeals of decisions of the Supreme Court may be made to the Dean of Students. If there is a vacancy or absence of at least three (3) of the justices, the remaining justice(s) may only act on administrative matters subject to later approval by at least three (3) justices. Preceding the Spring General Election, the Chief Justice shall prepare and submit to the Senate Finance Committee a budgetary proposal for the next fiscal year for the Judicial Branch of the government. Details of court procedure not prescribed by this Constitution or by law shall be the responsibility of the court itself.
Records The Supreme Court shall keep an SANMIMT Book of Law which shall include all referenda passed into law by the student body and all bylaws passed by the Senate. Permanent records of the Constitution, Amendments, Laws, Interpretations, and written explanations of Interpretations are to be kept by the Secretary.
Subpoenas Any Justice, upon written request for the issuance of a subpoena ordering a person to appear before the Supreme Court, may issue such subpoena. The subpoena may be contested before the Supreme Court. Any student failing to comply with a properly issued subpoena may be suspended from SANMIMT Government offices and committees. Any student failing to comply with a properly issued Court Order may be suspended from SANMIMT Government offices and committees.
Contempt of Court Any act, which is calculated to hinder or obstruct the Supreme Court in its administration of justice, may be considered in contempt of court. Any student or group found guilty of contempt of court may be suspended from SANMIMT Government offices, committees, and/or funding. A party may be found guilty of Contempt of Court only if: the act is done in the presence of the court and its presiding Justice.
Disciplinary Action
Disciplinary Actions Mandatory mediation: mediation that must be held between the accusing student, the accused official, the SANMIMT Vice President, and another neutral party that both the student and the accused official agree upon. Suspension: removal of duties, rights, and voting privileges associated with the position for a period of no longer than four (4) weeks. Removal from office: removal of duties, rights, and voting privileges associated with the position for the remainder of their term, with a minimum requirement of one (1) semester.
Grounds Call for disciplinary action may be brought against any elected or appointed official in the SANMIMT Government by any student. Grounds for disciplinary action shall be violation of law(s), willful neglect of office, willful malfeasance, or gross misconduct.
Procedures Motions to discipline elected or appointed officials of the SANMIMT Government may be brought by any student before the SANMIMT Senate in the form of a written motion and seconded by at least two (2) senators. Disciplinary actions against an elected or appointed official may be ordered only by a majority vote of those SANMIMT Senators present and voting. In the case of removal from office, a two thirds (2/3) vote of the seated Senate is required. If the motion is passed, the President may not veto said motion. The charges shall be considered at a separate hearing before the SANMIMT Senate. The hearing shall be held at least eight (8) calendar days after the date of actual written notification of the official who is the subject of the motion.
Vice President If the SANMIMT Vice President is the accused official, the President Pro-Tempore shall replace the Vice President in the mediation process.
Appeals Disciplinary decisions by the SANMIMT Senate pursuant to this ARTICLE may be challenged in the Supreme Court on the grounds that the procedures were not followed in good faith, or on procedural or legal grounds.
Finance
Student Funds The funds of the SANMIMT Government shall be derived from designated SANMIMT fees, income from enterprises of the SANMIMT Government, and other legally approved sources.
Authorization of SANMIMT Fees An SANMIMT fee shall be levied on each undergraduate student at the University subject to authorization by the NMIMT Board of Regents. For each part-time student carrying at least one (1) credit hour, the fee shall be prorated according to the number of credit hours registered and paid for by the student.
Distribution of the SANMIMT Fee The Finance Committee shall present all SA Government budgetary proposals received before the Spring General Election accompanied by the Finance Committee's recommendations to the Senate for approval no later than the first regularly scheduled meeting following the Spring Semester. The combined proposed budgets for the SA Government shall not exceed fifty percent (50%) of the anticipated revenue for the following fiscal year. Any funds not allocated by the SA Government budget proposals may be allocated by the Senate according to established laws and statutes. Any financial request must first be approved by the Senate Finance Committee. If an organization or person is denied funding or change of funding allocation by the Finance Committee, they may appeal the decision to the Senate in the form of a bill.
Authority of Financial Control The SANMIMT Chief Financial Officer shall be the sole fiscal agent for all SANMIMT Government financial transactions. All expenditures must have prior clearance from the SANMIMT Chief Financial Officer. The SANMIMT Government, executive agencies, and any organizations funded through the SANMIMT Government may not spend in excess of their approved allocation. This will result in termination of any agent involved and a formal inquiry into the actions of the appropriate executive officer, President, or Vice President. Deficit spending may result in substantial penalties as governed by SANMIMT Government law.
Education in Financial Matters Agents shall be responsible for familiarizing themselves with the SANMIMT Government and SANMIMT Chief Financial Officer policies and financial procedures before any expenditure is made.
Accounting Requirements All SANMIMT Government accounting systems shall be in accordance with appropriate federal, state, and University requirements.
Ownership All items purchased with SANMIMT Government funds become the property of the SANMIMT Government and thus the property of the New Mexico Institute of Mining and Technology Board of Regents.
Election Procedures
Election of Senators Senators (as outlined in ARTICLE III, Section 3) shall be elected at large from among those candidates declared eligible by the Supreme Court. Candidates for senatorial seat must receive a minimum of two (2) votes during an election to become a Senator.
Election of the President and Vice President The President and Vice President shall be elected at large in the Spring General Election from among those candidates declared eligible by the Supreme Court.
Senate Vacancies In the event of a vacancy in the Senate, the candidates receiving the next highest number of votes from the election for that session that did not receive a senatorial seat shall fill that vacancy. Senatorial duties shall be assumed upon confirmation by the Supreme Court and swearing in by a Supreme Court Justice in a timely manner. In the event that the position is refused or the Vice President (after reasonable attempts) is unable to contact the candidate within ten (10) days, the next candidate on the above described list shall be appointed. This process shall continue until all vacancies are filled or there are no remaining candidates to fill the vacancies. In the event that there are no remaining candidates to fill the vacancies, the Supreme Court shall hold a special election. Senators elected during a special election shall be treated as candidates remaining from the previous General Election. The newly elected Senators shall fill the term of office of the Senator they are replacing. The newly elected Senators with the highest number of votes shall fill the longer terms available to be filled.
Election Process All elections shall be run in accordance with the procedures outlined in the SANMIMT Book of Law and run by the Supreme Court. The Supreme Court shall set the dates for all elections. Only members of the SANMIMT and GSANMIMT shall vote at elections held by the Supreme Court. All votes shall be cast by secret ballot; each person may only vote once. GSANMIMT members may vote on all SANMIMT ballots except for senatorial seats. At least two (2) members of the Supreme Court shall be present when the votes are tallied. In the event of a disputed vote, the Supreme Court shall decide the dispute. Any candidate may demand a recount within fourteen (14) calendar days of the election's end.
Referenda
Law Legislation may become law via referendum. Referendum items shall be put to a vote of the student body during elections. Referenda that are passed by a majority of those students voting shall become SANMIMT Government law. All referenda passed into law by the student body shall override the bylaws of the Senate, and both forms of law shall be identified separately in the SANMIMT Book of Law.
Repealing Said laws shall be binding on the SANMIMT Government for one (1) year following passage into law provided it is within SANMIMT Governmental power to enact the provisions of the referenda. Said laws may not be overturned by any actions of the Senate or the President. Said laws may only be repealed or amended via referenda. Said laws shall remain enacted until repealed or amended.
Overturning The student body may overturn actions of the Senate or Presidential vetoes through the referendum process by a majority vote of those voting.
Voting Referenda may be placed on the SANMIMT ballot by a majority vote of the seated Senate or by petitions presented to the court and signed by one half (1/2) of the number of students voting in the previous General Election.
Amendments Amendments to this constitution may be proposed by a two thirds (2/3) vote of the seated Senate or by petition signed by two thirds (2/3) of the number of students voting in the previous election. The proposed amendment shall be placed on the ballot of the next election. An affirmative vote by two thirds (2/3) of those students voting on the amendment shall be sufficient to approve the amendment. Amendments of this Constitution approved by the student body shall be placed in the appropriate context within this document, including specific numerical references (ARTICLE, Section, and subsection). The previous replaced text (if any) shall be recorded in a historical record. If this Constitution becomes inadequate the Senate shall replace this Constitution subject to the same rules as outlined for constitutional amendments.
Implementation This Constitution shall become the law of the SANMIMT and its Government the calendar day after Commencement of the Spring Semester in which it was ratified or the Spring Semester following its ratification if ratified during a Fall Semester. Upon implementation of this Constitution into law, a Book of Law to accompany this Constitution shall be implemented. The Book of Law may be ratified before the implementation of this Constitution. Upon the implementation of this Constitution into law, all laws and bylaws associated with the previous Constitution shall be considered repealed. Upon implementation of this Constitution into law the current Supreme Court shall be dissolved and new Justices appointed. The President shall appoint the Chief Justice and two (2) Associate Justices. The President Pro-Tempore of the Senate shall appoint the other two (2) Associate Justices, and all appointments shall be subject to the ratification of the Senate. All previously elected officials shall be allowed to complete their elected terms, overriding the twenty-one (21) member limit of the Senate through the end of the Fall Session following the ratification of this Constitution.
This book of law has been created to establish a set of rules that govern the SANMIMT Government under the SANMIMT Constitution. All referenda and bylaws of the SANMIMT and its Government are recorded herein. Legislation vetoed by the President may be overridden by the Senate by a two thirds majority vote. The Vice President shall be responsible for taking attendance of the Senators at all Senate meetings, relaying attendance information to the Secretary to be placed in the meeting minutes. The Vice President shall announce at each Senate meeting all Senators who qualify for consideration for removal due to lack of attendance as outlined by SANMIMT law. The Vice President shall send all correspondence to specific Senators concerning disciplinary action upon that specific Senator; if the Vice President is not able to carry out this duty due to a serious conflict of interest, he or she may solicit the aid of the President Pro-Tempore of the Senate. The Vice President shall have the power to require any committee of the Senate to submit a written report to the Senate as often as once every four (4) weeks and shall have the power to require any committee to meet as often as once every four (4) weeks. All required meetings shall be announced to the public at least three (3) days in advance. The Vice President shall draft a letter to the GSANMIMT and Dean of Graduate Studies whenever a Graduate Student Representative position becomes vacant, requesting the name of the replacement Representative. The Vice President shall publish and update a manual outlining the process for drafting bills each session. This manual shall include a document template and example bill. The Secretary shall be responsible for the duties of managing the SA web page, managing the SA email account, and making available to the SA Government and public a contact list including all elected and appointed officials. The Secretary shall post meeting agendas and notice of meeting time and place at least five (5) days prior to each regularly scheduled meeting and the first two (2) meetings of each session. The Finance Committee shall present to the Vice President for drafting into legislation a list of procedures the Committee deems necessary to be passed into law. The Vice President shall present this legislation to the Senate to be voted upon at the next possible Senate meeting. The Finance Committee shall be allowed $500.00 each session which the Committee may allocate as they see fit without Senate approval. The balance of these funds remaining at the end of each session shall not roll over to the next session. The Appointments Committee shall be required to report to the Senate when any specified SA Government position becomes vacant and shall announce all vacancies at every Senate meeting until each position is filled or the Senate resolves not to fill the position. These positions shall include all Presidential appointments, the Secretary, all persons on the Finance, Legislative Standards, and Appointments Committees, and any other positions deemed necessary by the Senate. The Appointments Committee shall also report as above for any Senate committee which which becomes entirely vacant. If a committee chair neglects their duties, the Vice President must first write an official memo to the chair detailing any issues, and then call a meeting to discuss the problems with the chair. If the issues are not resolved, the Vice President must take issues to the Senate. With a majority vote of the Senate, the Chair can be removed from their position as chair. If a committee member misses two meetings without documented notification to the chair, the committee member can be removed from the committee by a majority vote of the Senate. If a committee member resigns or is removed from the Finance, Legislative Standards, or Appointments Committee, the Vice President shall appoint a new committee member with concurrence of the Senate, no later than the next regularly scheduled Senate meeting following the meeting at which the committee member resignation is announced. At the last regularly scheduled meeting of a session the Senate shall set the time and place of the first meeting of the next session. During the first meeting of a session the Senate shall set the time and place of the second meeting. At the second meeting of the session the Senate shall set the place and time of the regularly scheduled meetings for the remainder of the session. The Senate may change the current session's schedule of meetings at any meeting that reaches quorum. Salaries of the regular employees shall be paid in biweekly increments distributed over the employee's period of employment. If the Vice President or President's seat becomes vacant, the pay for the outgoing and incoming persons shall be prorated according to the number of days in which each person performed the duties of the respective office. If a Senator is unable to attend meetings, due either to absence for the summer session or serious illness, a leave of absence can be granted with a majority vote in place of removal. Senators granted this leave would loose their vote and be removed from quorum requirements for the duration of their absence, yet still retain their seat. Once a Senator returns from their absence, the leave may be terminated, and their vote returned to quorum. Under no circumstances is a Senator on leave accountable for attendance during their period of leave. Senators who wish to request a leave of absence for the summer session should request this of the Senate at or before the last meeting of the Spring Semester. The President shall be allowed $250.00 each session which he or she may allocate as they see fit without Finance Committee or Senate approval. The balance of these funds remaining at the end of each session shall not roll over to the next session. This shall be known as the Presidential Discretionary Fund and is intended to be used primarily for covering unforeseen costs within the operation of the Government. The Chief Financial Officer, in conjunction with the Finance Committee, shall be responsible for publishing a financial procedures manual for the purpose of informing all interested persons of the procedures necessary to obtain and legally spend SANMIMT Government funds. It shall be the responsibility of the Chief Financial Officer to assure that all transactions and procedures within his or her control follow all federal, New Mexico, and University laws and procedures. The Student Activities Director shall coordinate a schedule of events for Dance, Activities, Movie, Spring Fling, 49ers committees, and other entertainment events of interest in conjunction with PAS, Macey Center, and other non-SA entertainment organizations on campus. The Student Activities Director shall publish said schedule at least two (2) times per semester and at least once during the Summer Session. Committees shall make final selections of all performances and production (sound, lighting) companies. An individual shall be appointed by committees who shall retain artistic control of each event while technical and artistic advisement shall be provided by the SA Technical Director and Student Activities Director to artistic directors as needed. The Student Activities Director shall be responsible for administration; including contracts, routing sheets, permissions, venues, and security needs for all SA approved activities or coordinated with committees or artistic directors. The Student Activities Director shall provide and administrate a policy concerning administrative procedure for entertainment activities subject to approval by the Senate. The Student Activities Director shall be provided a separate telephone line and answering machine to be in the committee office. There shall be an executive agency for the purpose of managing SANMIMT property and facilities and their usage. There shall be an SA Technical Director appointed by the President to be the director of this agency. The Technical Director's duties shall include the maintenance and purchasing (under the authority of the Chief Financial Officer) of non-permanent (not integral to the building in which it resides) student owned equipment other than equipment intended primarily for use by a chartered organization or purchased by a chartered organization intended primarily for chartered organization use. The Technical Director's duties shall also include the managing of the usage of said maintained equipment and the training of its users. The Technical Director shall also manage the usage of all facilities owned and/or operated by the SANMIMT to the utmost authority of the SANMIMT Government (under the authority of the President). The Technical Director shall submit a budgetary proposal for the next fiscal year for this agency to the Senate Finance Committee prior to the Spring General Election. If the Technical Director position is not filled, the President shall submit a budgetary proposal for the next fiscal year for this agency to the Senate Finance Committee prior to the Spring General Election. There shall be an executive agency for the purpose of producing a regularly scheduled publication concerned with student interests. There shall be an Editor-in-Chief appointed by the President to be the director of this agency. The Editor-in-Chief shall be responsible for the entire operation of the publication, maintaining its equipment, planning for the publication's future, and managing all of the publication's employees. The Editor-in-Chief may appoint additional employees to aid in the Editor-in-Chief's duties. The Editor-in-Chief will work with the SA Technical Director on equipment maintenance and in future planning where equipment is involved. The Editor-in-Chief shall submit a budgetary proposal for the next fiscal year for this agency to the Senate Finance Committee prior to the Spring General Election. If the Editor-in-Chief position is not filled, the President shall submit a budgetary proposal for the next fiscal year for this agency to the Senate Finance Committee prior to the Spring General Election. There shall be an executive agency for the purpose of managing the campus radio station. There shall be a General Manager appointed by the President to be the administrator of the radio station. The Manager's duties shall include updating station documentation, acting as station treasurer, serving as liaison to the NMIMTSA, DJ management, acting as liaison to the SATD about equipment upkeep and problems, general upkeep, and station development. The General Manager may appoint additional employees to aid in the General Manager's duties. There shall also be a Music Director for the radio station who shall be appointed by the President. The duties of the Music Director shall include reviewing all music received, making music available to DJs, maintaining industry contacts, and communicating with the General Manager and making the General Manager aware of problems or misuse of the equipment or property. The Music Director may appoint additional employees to aid in the Music Director's duties. The General Manager and Music Director shall together submit a budgetary proposal for the next fiscal year for this agency to the Senate Finance Committee prior to the Spring General Election. If either the General Manager or the Music Director position is not filled, the President shall aid the employee in the filled position to create and submit a budgetary proposal for the next fiscal year for this agency to the Senate Finance Committee prior to the Spring General Election. If neither the General Manager nor the Music Director positions are filled the President shall submit a budgetary proposal for the next fiscal year for this agency to the Senate Finance Committee prior to the Spring General Election. Rules for the SAC No one may remove equipment from the SAC without prior approval from the SATD. One week notice is required. Technicians must be trained each semester. The list of approved Tech Ones and Twos is only good for one semester. The length of time for the list may be extended by the SATD if more time is needed to train and approve the new Tech Ones and Twos. Rooms in the SAC may only be reserved by contacting the SATD. The person who is going to be using the equipment or the room must check out the keys to the room. Rooms may only be used for the event that is scheduled in that room at that time. The person who checks out the room is responsible for making sure that everything is put back in its proper place, for making sure that doors are locked and for any damage done. Should any damage occur, the campus police and SATD should be notified at once. Rules for Tech Ones Only those that are on the list of approved Tech Ones and Tech Twos may run the sound and lighting equipment. The Tech who checked out the room is responsible for all of the equipment in the room. It is the duty of the Tech who checked out the room to make sure that all the doors are locked and that all the equipment is properly put back. Rules for Tech Twos All Tech Twos are required to follow the rules for Tech Ones. A Tech Two may remove equipment from the SAC, with the permission of the SATD. A Tech Two may change the lighting in the SAC, with the permission of the the SATD. A Justice may not be a member of the GSANMIMT. If a Justice becomes a member of the GSANMIMT, his or her term is ended, effective immediately. In the event of the Office of Chief Justice being vacated, and there being seated Justices, the President shall appoint any qualified individual, as stipulated in Article V, Section 3, to the position of Chief Justice. In the event of the seat of an Associate Justice being vacant, the President shall appoint a new Associate Justice. In the event of the entire court being vacated, the President shall appoint two Associate Justices, and the President Pro-Tempore shall appoint two Associate Justices. All appointments shall be subject to ratification by the Senate. The newly appointed Justice shall be given a term as defined by Article V, Section 3. If the Justice is seated during a session already in progress, his or her term is counted as having started at the beginning of the session. All Justices will be given an SANMIMT owned copy of Robert's Rules of Order, to be used throughout their term. At the beginning of the Justice's term, a $15 deposit is required to receive the book. If at the end of the Justice's term, the book is not returned or is returned in unsatisfactory condition, the Justice will not have his or her deposit returned. The deposit will then be used to purchase a replacement copy of the book. A Senator who neglects to attend two (2) consecutive or three (3) non-consecutive non-emergency Senate meetings in one (1) session of the Senate may be considered for removal from office by the Senate. If a Senator meets the above criteria at the last meeting of the session, the Senator is eligible for removal during the next session. If a Senator meets the above criteria at the end of his or her term, the Senator is not eligible during his or her next term. The Vice President shall send a Senator who meets the criteria in ARTICLE VI, Section 2, subsection A of the Book of Law two (2) notices via campus mail. The first notice shall be sent not less than ten (10) days before the meeting following the meeting at which the Senator met the above criteria. The second notice shall be sent not less than four (4) days before the meeting following the meeting at which the Senator met the above criteria. If the meeting at which the Senator met the above criteria and the meeting directly following are less than ten (10) days apart, the Senator shall be sent at least one (1) notice in the mail as soon as possible. Under either circumstance the Vice President shall attempt to contact the Senator via telephone and electronic mail. In total, the Vice President shall attempt to contact the Senator at least four (4) times including all notices, telephone calls, and electronic mail messages before ceasing in his or her efforts to contact the Senator. All chairpersons of events funded by the SA Government shall be required to keep a record of how much money was spent on each event and the number of students and non-students that attended each event. This information is to be used for future budgeting and for evaluating each event's success. All General Elections shall be held on or between the first week of classes after mid semester and the second-to-last week of the semester (as defined by the most recently published New Mexico Tech Catalog). The date and purpose of a General Election shall be advertised for thirty (30) days before the date of the election. Declaration of candidacy forms shall be made available and submissions of candidacy shall be accepted twenty-five (25) days before the election date. All candidacy forms must be submitted at least five (5) days before the election date. The date and purpose of a special election shall be advertised starting no later than two (2) days after the Senate meeting at which the special election becomes necessary. The special election shall be held between ten (10) and fifteen (15) days after the date of the Senate meeting at which the special election became necessary. Declaration of candidacy forms shall be made available and submissions of candidacy accepted the day that the special election becomes advertised. All candidacy forms must be submitted at least two (2) days before the election date. If a special election becomes necessary within the last twenty (20) days of the academic session, the special election shall be held the next academic session. In such a case the above guidelines shall be followed and the election shall be considered necessary as of the first day of classes of the new academic session. The Supreme Court shall insure that all candidacy forms for all elections contain a list of eligibility requirements. An election shall start on the day advertised to the student body and must run from a minimum of 8 A.M. to 6 P.M. on that day. Once the election has begun it can not be paused, postponed, interrupted, or relocated. The ballot box shall remain open until the closing of the election by the Supreme Court. The election shall be held in a single location regularly accessed by the voters. At least one Supreme Court Justice shall be present at the ballot box at all times during the election. The Supreme Court shall insure that there is neither campaigning nor any visible or audible campaign materials within one-hundred (100) feet of the ballot box during the election. Spring General Election ballots shall have senatorial seat candidates divided by their respective first major, either from the Arts & Sciences or Engineering divisions of the Institute. All undergraduate voters shall be allowed choose up to two (2) candidates from each division. All voters shall be allowed to vote for one (1) Presidential candidate and one (1) Vice Presidential candidate. All undergraduate voters shall be allowed to choose up to four (4) candidates from the candidates on the Fall General Election ballot.

The hierarchy of the Book of Law shall follow the hierarchy of the Constitution (capital roman numeral, number, capital letter) as near as is reasonable. Newly approved laws and referenda in the Book of Law shall be placed in the appropriate context within this document, including specific numerical references (ARTICLE, Section, and subsection).

Each year the SA shall award the NMT Service Award and a plaque to the graduating Senior who, in the estimation of the SA Senate, has done the most for the students of Tech. Service is the sole consideration and current SA officers and Senators shall be eligible for the award. Nominations for this award may come from faculty, staff, or students. The Senate shall determine the recipient of the award.
Any person resigning from any SA Government position must inform their immediate supervisor and the Appointments Committee at or before the time of their resignation.
All Presidential appointees, the President, Vice President, and Secretary must write or update a manual of duties concerning their position at least once a year. Each manual is intended to be used as a training aid for persons newly elected or hired and as a duty and procedures reference (with references to the Constitution and Book of Law as appropriate) for those persons. Updated copies shall be supplied to the Secretary to keep on record.
The President, Vice President, and Chief Justice shall update each session and provide to the Secretary to keep on file job descriptions of elected and appointed positions in their branch of the Government. These positions shall include all positions within the Executive Office of the President, all executive agency directors, and any other positions in the Executive Branch deemed necessary by the President. These positions shall include the Finance, Legislative Standards, and Appointments Committees' chairs and the Secretary and any other Legislative Branch position deemed necessary by the Vice President. These positions shall include Chief Justice and Associate Justice and any other position in the Judicial Branch deemed necessary by the Chief Justice. Updated copies of all job descriptions shall be supplied to the Secretary to keep on file and make available to anyone who requests a copy.
The President, Vice President, and Chief Justice shall keep on file with the Secretary all applications (including resumes) for all positions outlined in ARTICLE XII, Section 6 of the Book of Law. All applications are to be reviewed at the beginning of each semester.

Any student may serve on a SANMIMT committee with the exception of the limitations on the Finance, Legislative Standards, and Appointments Committees. All Senate committees, with the exception of the Finance Committee, may reelect their own chair. Any funds not allocated by the SA Government budget proposals may be allocated by the Senate according to established laws and statutes. Any financial request must first be approved by the Senate Finance Committee. If an organization or person is denied funding or change of funding allocation by the Finance Committee, they may appeal the decision to the Senate in the form of a bill. "...consider all presidential appointments..." means that the Appointments Committee shall be allowed to inspect all pertinent documents to make sure the best person for the position was picked for the position. A week is a seven (7) calendar day block of calendar days from Sunday to Saturday, inclusive. What this means is that a Senate meeting could be held on a Sunday and the next senate meeting could be held on the Saturday twenty (20) calendar days later. Note: this example is the most extreme case of valid times for Senate meetings. Whereas: The NMIMT Student Senate is the official voice of the undergraduate student body. Resolve that it would be in the best interest of new and returning undergraduate students to not transfer or move any funds from the undergraduate scholarship fund to graduate fellowships. Whereas: The regents of NMIMT are considering a legal name change. Whereas: The senate has been asked to express its opinion. Whereas: The NMIMT Student Senate is the official voice of the undergraduate student body. Resolve that it would be in the best interest image and history of the institute to retain the name "New Mexico Institute of Mining and Technology" as the official designation. Whereas: It has come to our attention that the Faculty Council has expressed interest in removing the Monday registration and Friday 49ers Holiday to form a week-long Thanksgiving break. Whereas: It is the opinion of the SA. that the 49ers academic holiday serves a useful purpose, being a stress relieving break just after mid-terms. Whereas: 49ers is one of a very few proud New Mexico Tech traditions remaining, and enhances school spirit. Whereas: Numerous scheduling difficulties will arise should the registration process be moved to an earlier date. Whereas: A week-long Thanksgiving break does not present any benefits to the student body, being so close to the end of semester. We resolve that it remains in the best interest not only of the Student body, but of the image and traditions of this Institution to leave well enough alone. We the Senate, resolve that the coffee shop is an intrinsic part to many students lives. Its importance lies in its ability to be a haven for many students on campus. There are few places of such an atmosphere that fosters group studying, programming, and club meetings. We desire the Coffee Shop open ASAP. Things we like include: Music - stereo attached to cable to get KTEK and other stations Computers ~5, more than that would decrease the family feeling of the area Fountain drinks, coffee, italian sodas, bagels, microwave popcorn Microwave, coffee pot, fridge, toaster No real vending machines, too sterile Is another location that students can have a job The Coffee shop is a service not a business Table space is very good. / Outdoor is great We wish the coffee shop will sell us ramen cheap We wish the nights to be every nights Hours we would like to see 7 - 3 am Whereas: The suggestions made by the students to change the tagline were examined and dismissed. Whereas: The suggestions made by the faculty council were examined and dismissed. Whereas: The new tagline was a collaborative effort by they entire New Mexico Tech community and therefore a general and majority consent and suggestion. Whereas: The quick dismissal of these suggestions made by the said participants was viewed as blatantly disrespectful and inconsiderate. We resolve that the suggestions made by the persons involved with the attempted tagline change be heavily reconsidered and reviewed in light of the Senate's support. Whereas: The Student Union Building exterior door, Post Office box door, and the outside gate to the patio area have been closed and locked prematurely. We the Student Association Senate resolve on behalf of the student body that the doors and gate in question be left open until the close of the Student Union Building on both weekdays and weekends (as per SUB policy). Whereas: The reason given for the closure of the Post Office box door was given as no other lock to protect campus dining property. We the Student Association Senate resolve that the door in the student quiet lounge that leads to campus dining should be equipped with its own lock. Whereas: South and Baca water falls on student approaching from the unguttered side. Whereas: Unguttered water splatters first floor residents and students. Whereas: Seasonal snow and freezing temperatures create a safety issue with undrained water. We the Student Association Senate resolve that gutters be attached along sides of Baca and South to drain water safely and unobtrusively. Whereas: The Technology Planning Committee has proposed a fee of $50 per semester (in Summer $25), estimated to intake $610,000 over the next four year period in order to cover Equipment Replacement for the NMT Tech Computer Center; and Equipment Replacement being an academic necessity which should be covered entirely by tuition, rather than a non-essential which would fall under the realm of fees. Whereas: The students of NMT are solely paying for this increase. Whereas: $50 per student per semester ($25 in Summer) is too much of a burden on the students; now, therefore, Be it Resolved, that the equipment supported by this increase, be assessable to all NMT students. Resolved, the charge per student per semester should not exceed $25. Whereas, There was much confusion among a certain body of voters as to their right to vote in the election held March 22, 2001. Whereas, Many of the members of this body of voters did not bother to go vote due to word of mouth. Be it, therefore Resolved, that we the Student Association Senate request that the proposed Constitutional Amendment, which failed by eight votes, be put on the ballot for the re-vote. Whereas: The most recent run-off election was changed and was not advertised. Whereas: The election did not follow the spirit of an election. This Senate resolves this election should be repeated as soon as possible. Whereas: South and Baca water falls on students approaching from the unguttered side. Whereas: Unguttered water splatters first floor residents and students. Whereas: Seasonal snow and freezing temperatures create a safety issue with undrained water. We the Student Association Senate re-resolve that gutters be attached along sides of Baca and South to drain water safely and unobtrusively.
